BHC dismisses application about ‘missing’ of BAP lawmakers

QUETTA: Balochistan High Court (BHC) on Friday dismissed a constitutional petition regarding the alleged kidnapping of four lawmakers from the ruling Balochistan Awami Party (BAP). A division bench of the BHC comprising Chief Justice, Mr. Justice Naeem Akhtar Afghan, and Mr. Justice Abdul Hameed Baloch observed that the petition does not fall within the definition of an aggrieved person within the preview of article 199 of the Constitution of the Islamic Republic of Pakistan.

BAP angry members including Sardar Abdul Rehman Khetran, opposition leader Malik Sikandar Advocate, Malik Naseer Shahwani, Nasrullah Khan Zaray, and others had filed petition seeking court’s intervention for the recovery of the ‘kidnapped’ lawmakers.

Petitioners have an alternative remedy: BHC

The bench said the petitioners have the alternative remedy of approaching the court of competent jurisdiction for redressal of their grievance in accordance with the law.

The lawmakers pleaded that four members including Bushra Rind, Mahjabeen Sheran, Laila Tareen, and Akbar Askani went missing on the occasion of a vote of confidence against Chief Minister Balochistan Jam Kamal Khan on October 20th.

“To change the number, 4 members are in the illegal detention of CM Jam Kamal”, Malik Sikandar Advocate pleaded before the court. However, the court dismissed the CP.
