BHC declares cash-award to Govt employees illegal

QUETTA: The Balochistan High Court (BHC) declared a cash award to the government employees for preparing the financial budget for the year 2020-21 illegal. A division bench of the BHC comprising the Chief Justice, Mr. Justice Jamal Khan Mandokhail, and Mr. Justice Abdul Hameed Baloch passed this order on Wednesday.

The grounds mentioned in the summary for the approval of cash award do not fulfill the criteria laid down in the definition of cash award 2019 rules, the bench observed. What was the contribution of other departments including CM Secretariat, Balochistan Assembly, PMA hostel, Governor’s House etc in preparation of the budget, the court questioned?

It may be mentioned here that Chief Secretary Balochistan, Captain (R) Fazeel Asghar has returned the cash award earlier. The court noted that the competent authority did not consider the theme and purpose of granting cash award, defined in rules 2019.

Amounts withdrawn by officers shall be recovered and deposited in government accounts 

In view of the above grounds, the bench allowed the petition for hearing and declared the cash award order illegal. The court also ordered that if the officials/officers have withdrawn, the same would be recovered and deposited in the government’s accounts.

The bench passed this order on a petition filed by Bayazeed Khan Kharoti who had challenged the cash award to officers and employees of various government departments by the finance department.
